Introduction

Ta’ Dirjanu Supermarket (hereinafter referred to as ‘Ta Dirjanu’ and/or ‘us’ and/or ‘we’) is a family heritage which has been operating in Gozo since 2002. While we have expanded our business by operating from three different local outlets across Gozo, we are now also offering online shopping service through our main website https://www.tadirjanu.com (hereinafter referred to as the ‘Site’) to all addresses in Gozo.

This website has been created to give you the possibility of making purchases from the comfort of your home or wherever you may be. By using this Site, you are agreeing to be bound by its Terms and Conditions.

Ta’ Dirjanu reserves the right to change and update its Terms and Conditions as may be required from time to time. We therefore urge you to check our Terms and Conditions when using this Site, taking particular note of the date of the latest update. Updated Terms and Conditions come into force and are applicable with immediate effect.

Creating an Account with us for Shopping purposes

You may browse freely through our Site to view the products available for purchase. In order to be able to place your order on the Site, you have to create an account by registering first. Once an account has been created, you may log in to place your order with us.

To create an account you must be sixteen (16) years of age or over. Persons under the age of sixteen (16) years are not allowed to create an account and place their orders through the Site. We thus request the date of birth when creating an account so we are able to verify your age. Customers creating an account and placing their orders thereby confirm that they are of age when placing an order, process payment, receive and use the products ordered from us.

You must provide the correct personal details when creating an account and should any details change thereafter, you can update your account details from the Site through the ‘Manage your Account’ section.

You should not disclose and/or share your account password. The account holder is held fully and solely responsible for all actions, activities and/or orders that are done through the same account. If you suspect any misuse, you are to immediately send us an e-mail on [email protected] .

Should we suspect or have reasonable doubt that a customer has provided incorrect details, or that the account is being inappropriately used and/or you are in breach of these Terms and Conditions, Ta’ Dirjanu reserves the right to suspend and/or delete a customer’s account at its sole discretion.

Orders, Pricing and quantity

Orders of our products are done through this Site. We are no longer accepting orders and offering deliveries via telephone or e-mail.

The price and the quantity of a product you may wish to purchase are indicated on each item. Prices quoted are inclusive of VAT.

As certain products are sold by weight (such as fruits, vegetables, meat and poultry), it is difficult to deliver the exact weight ordered. Although we will try our best to deliver these products in the nearest weight as ordered, you will be charged for the actual weight delivered.

Delivery

Delivery service is available to all addresses in Gozo.

Deliveries of items ordered will be made according to your selected option indicated above and always dependent on the amount of orders we have in queue. If we believe that the delivery will not be within an acceptable time frame, we will contact you in advance.

Deliveries are carried out from Monday to Saturday during normal business hours. No deliveries are carried out on Sundays and Public Holidays.

Food and Chilled items are delivered in temperature-controlled vehicles, thus ensuring quality and freshness of the goods.

Deliveries will be done to one’s main entrance to the premises, as indicated in the order. If the premises is not on the ground floor, but a lift is available, we will still deliver to your door.

Return Policy

Given that we offer a wide range of products, the return policy differs depending on the product.

Products are to be returned in their original form and undamaged packing as delivered.

In the case of food items, these are to be returned within twenty four (24hr) hours from delivery, whilst non-food items are to be returned within fifteen (15) days from the date of delivery.

Refrigerated and frozen goods are non-returnable once the Company’s Delivery Vehicle has departed from the place of delivery. If still on site, the delivery person can only collect and return the item following approval from Administration.

Products which cannot be resold once unwrapped cannot be returned.

Depending on the returned item, we will either exchange the product, give you your money back, offer you a credit note or offset the amount paid from your next bill.

If you purchased only the retuned item and thus incurred a delivery cost, we will also refund the delivery cost. If on the other hand, the product was exchanged and/or the returned item was purchased together with other products, the delivery cost will not be refunded.

Payment

Payments of the order is done either by card on the website itself or cash-on-delivery.

1. 1. Online Shopping Payments directly by Card on our Website
   When a customer is placing an order, our website will request to reserve the amount due by executing a pre-authorization process directly via the BOV merchant system. Money is not being taken from his/her account before the order has been processed. Prior to dispatch, the system will capture the total bill from the reserved amount for the products the customer has purchased on our Website. Should the total bill be greater than the reserved amount, the customer shall be contacted regarding the difference and his/her permission sought to proceed accordingly.
   Please take note that the card can only be used on the website and payment cannot be made via epos.

2. 2. Online Shopping Payments COD (Cash on Delivery)

   When placing an order and selecting the Cash on Delivery option from the dropdown, payment will be settled in cash upon delivery of the purchased items, whereby a receipt will be issued signed both by the Purchaser and the Deliverer. Customers are being informed that it is preferable to settle with the exact amount of cash to avoid problems with change.

The products available on the Site are represented by means of an image. These images are for illustration purposes only.

Copyright and Intellectual Property

All designs, texts, graphics, images, information, content, logos etc contained in this Site, are the property of Agius Services Limited and Ta’ Dirjanu Supermarkets and is protected by applicable copyright and trademark laws, and may not be duplicated, copied, modified, or adapted in any way without our written permission. Our Site may contain our service logos or trademarks as well as those of our affiliates or other companies, in the form of words, graphics, images and logos. Your use of the Site is solely to serve as an online shopping channel of our products. The scraping of this website and it’s content is prohibited. Any unauthorized scraping of our website's content, both for information purposes or for commercial purposes, will be considered a violation of intellectual property rights and appropriate legal action against the individual, third-party company or authority will be taken. Your use of the Site does not constitute any right or license for you to use our service logos or trademarks, without our prior written permission. Our content as found within our Site is protected under Maltese law and international copyright laws. The copying, redistribution, modification, use of publication by you of any such content is strictly prohibited. Your use of our Site and services does not grant you any owner ship rights to our content.
